Malaybhai--Querry

* An Indian Resident person (Mr. A) is working in TCS. In Jan'05 he was posted for a project in UK. For the entire fy 05-06 he was in UK. His salary was paid in India after TDS. He was getting an allowance of 200 Pounds per month. Now that he is back in India, he transferred some 1000 Pounds, out of his savings from the allowance, in his Indian account. Will this amout transferred be subject to tax?

Dear Malaybhai,

If this is amount is transferred from perdiam Allowance than the same is taxable as perquisite. If this is not an allowance and the same is salary paid for work done there than the same is not taxable,

Firstly the amount of 200pounds even if given in london would have been a part of the package and this would have been treated as perquisite and taxed and hence when brought back it would not be taxable.
On the other hand if this amount was not taxable and was given as living allowance in london for food etc then it would be a matter similar to flying allowance given to air hostess for which the dept is treating as perquities and the it is constested in the court the outcome is not known to me as of now i will have to check
